How the New NYC Building Codes Impact Elevators & Escalators

Does your building in New York City have elevators and escalators? If so, you need to be aware of the new NYC building code changes that went into effect on January 1st, 2022. The following additions and changes will impact the way elevators and escalators are inspected and tested in NYC.

No More Subcontracting for Periodic Inspections

One of the most notable changes will be that the NYC Department of Buildings can no longer subcontract “Periodic Inspections” to “PVT Agencies.” Instead, yearly performance inspections of elevators and escalators will be the sole responsibility of the building owner.

Inspections Must Be Performed by Approved Elevator Agency

Vertical transportation inspections in NYC must now be performed by an approved elevator agency that is not affiliated with the elevator agency performing the maintenance. Inspections can no longer be performed by private subcontractors in the interests of the NYC DOB Elevator Division. Building owners, at their expense, will be required to contract with approved elevator agencies. Also, inspections will now be called “Periodic Inspections.” This is in addition to Category 1 & 5 inspections.

Periodic Inspections

Between January 1st and December 31st, periodic inspections will occur at a minimum of three months after a Category 1 inspection or previous periodic inspection. This will ensure they’re working at peak performance. Also, new installations must have an initial periodic inspection in the following calendar year after the final acceptance test.

For private residence elevators, periodic inspections and Category 1 & 5 inspections are allowed to be performed on the same day. Filing of Periodic Inspections must be completed within 14 days of the inspection date.

If any defects are found during a periodic inspection, they must be repaired and corrected within 90 days. The building owner can file an extension of 45 days if the issue cannot be rectified within the 90-day timeframe. Building owners will not be allowed to file more than two extensions for a certain defect. After the correction is made, an Affirmation of Correction will be filed within 14 days.

Category 1 & 5 Inspections

The completed reports with applicable signatures for Category 1 & 5 inspections must be filed within 21 days after the test date. Although there is an exception. Reports for private residence wheelchair lifts and private residence dumbwaiter devices are not required to be submitted to the department. However, the building owner is required to maintain an inspection and test log so that the department can view it if requested.
